There were questions raised about the legality of such a resolution under state law, which prohibits municipalities from expending resources on proposed bond initiatives. It is believed that the law originated to apply specifically to the municipality’s own ballot questions. However, the council has been told the Arizona Attorney General’s Office has interpreted the law in a broad manner to include any bond proposals.
Town Attorney Aaron Arnson noted in a memo to council members that penalties have been assessed to individual officials under this statute, but not municipal entities.

Town Councilman Allen Skillicorn was critical of Mayor Ginny Dickey for proposing the resolution saying the town should not engage in the political discussions of other entities. “How dare she use her power to tell people how to vote.”
The item remains on the council agenda because the decision to remove the discussion was too late to revise the agenda.
Fountain Hills School District Superintendent Cain Jagodzinski is scheduled to make a presentation with information on the bond to the Town Council at tonight’s meeting.
