Jorge, a poor Mexican laborer, sneaks across the U.S. border one night in order to better his lot in life by working in the U.S. This is illegal. Let’s hunt him down, deport him and otherwise make life miserable for this interloper. And the populace cried out in approval.

Nelson, a retired teacher from Iowa, drives through the red entry light to the 101 and then proceeds to speed at 90 mph, endangering the lives of many other drivers and their passengers.

Both incursions are photographed by law enforcement cameras. Both actions are illegal. But wait, these cameras are unconstitutional searches to my God-given rights to run red lights and speed. They should be done away with and the tickets nullified.

Both incursions are photographed by law enforcement cameras. Both actions are illegal. But wait, these cameras are unconstitutional searches to my God-given rights to run red lights and speed. They should be done away with and the tickets nullified.

And the populace cries out “foul” and goes about enacting laws to thwart law enforcement in its efforts to promote safety on the highways.

There is a disparity in judgments here. Perhaps it depends on whose ox is being gored. The poor Latino knowingly broke the law and must be persecuted and punished. The speeder, while caught in the act, was trapped outside the limits of the constitution and should be absolved.

Judge not lest ye be judged. Let him who is without sin cast the first stone.
