Effort to derail referendum lawsuit rejected by Fountain Hills council

Vote was 4-3 opposing resolution

A proposed resolution failed that would have directed Fountain Hills Town Attorney Aaron Arnson to not oppose a lawsuit recently filed against the town. This came after the town clerk rejected referendum petitions filed to present a council zoning decision to voters.

The resolution also directed Arnson to communicate such non-opposition to the court.

The mayor and all six council members were named as defendants in the suit currently before a judge with Maricopa County Superior Court. At this juncture Judge Frank Moskowitz denied motions by each party to dismiss the suit. The next court date is a status conference on Wednesday, April 24.
