Federal judge to deny motion by Councilman Skillicorn of Fountain Hills

Suit alleges sanctions illegal

In a tentative ruling released July 30, U.S. District Court Judge Dominic Lanza states he is denying a motion for an injunction by Fountain Hills Town Councilman Allen Skillicorn in a lawsuit against fellow council members, the Town of Fountain Hills and an outside attorney hired by the town to investigate alleged code of ethics violations.

The hearing on the motion is scheduled for Aug. 13. Lanza provided his reasoning in the July 30 order.

“The point of providing (the ruling) beforehand is to streamline oral argument and enhance the parties’ ability to address any perceived errors in the court’s tentative analysis,” Lanza stated. “This is not an invitation to submit additional evidence or briefing.”
