An outside attorney investigating an ethics complaint against Fountain Hills Town Councilwoman Brenda Kalivianakis returned a report to the town attorney earlier this month saying there was no basis for the complaint.
The investigation was based on a complaint filed Sept. 1, saying Kalivianakis violated the Town Code in asking Development Services Director John Wesley to look into what she perceived as a sign code violation. The complainant stated this is a violation of Town Code Section 3-1-1 (1), which states, “Except for the purpose of inquiry, the council and its members shall deal with the administrative branch solely though the town manager, and neither the council nor any member thereof shall give orders to a subordinate of the town manager either publicly or privately.”
The complaint alleged that Kalivianakis had asked Wesley to have the offending sign removed.
