The Fountain Hills Town Council will consider a fiscal allocation for repayment of taxes due to a court decision on a challenge of Maricopa County Assessor’s practices.
A lawsuit was filed against Maricopa County in 2016 known at Qasimyar v. Maricopa County in which the assessor’s practice of not making changes when an owner changed the use of owner occupied and secondary occupancy. The court ruled on the lawsuit that the property should be reassessed when a reclassification was made. An appeals court upheld the decision in 2021.
The result is that the county owes property owners a significant amount of money in back taxes.
