Judge sets status conference in Fountain Hills case

ROT challenge to referendum petition rejection

A Maricopa County Superior Court judge has set the date of Wednesday, April 24, for a status conference in the lawsuit challenging the rejection of referendum petitions.

Judge Frank Moskowitz met with parties on Wednesday morning, March 13, with an order to show cause in the case. He set the status conference at that time.

The parties discussed a motion to dismiss filed by the attorney for the developer. Moskowitz ordered attorneys for the plaintiff (Reclaim Our Town) to file a response to the motion for dismissal by Monday, March 25. The defendants’ attorney has until Monday, April 1, to respond to that reply.
