In 2014 I began to experience some serious issues with a healthcare provider in Fountain Hills.

Stalled by the doctor again and again, I turned to my elected officials for help.

I contacted Andy Biggs, David Gowen and John Kavanagh. Each offered some assistance.

I met in your office, told you the doctor refuses to give me copies of my medical records, x-rays, test results, referrals from other physicians, and you practically jumped up in your chair and said something to the effect “that's crazy, he has to, it’s the law.”

You said, “I’ll look into this and have my assistant call you.” I left your office with good feelings and optimistic. Everyone said the same thing. It’s the law, dang it, Senator Kavanagh is going to help. With his help and reputation, I will get my medical records. Easy-peasy.

I still do not have them. Prove to me, the doctor and community it’s the law.

You and your colleagues recommend I file complaints with the Medical Board, small claims court, HIPPA, Governor’s Office, Ombudsman’s Office and the V. A. His attorneys have quashed every attempt. Why ?

Senator, regardless of the investigation outcome, the aggrieved citizen is not allowed to know the results. You and your kind wrote the law to say, Mr. Citizen, you will never know what happened.

The Ombudsman attorney writes, if I want a copy of their investigation, I’ll have to file a lawsuit.

You knew this beforehand. If you cannot get answers, who can?

I am turning to you again, Mr. Kavanagh. State and federal laws support your position. As a citizen of your district, I deserve a fair answer. I simply want a complete and accurate copy of my medical records. I expect to hear from you soon.
