Northern Heights

The annual meeting of North Heights occurred March 30. There was an election for three positions on the board, as well as voting on IRS Ruling 70-604. No explanation was with the ballot as to what a yes or no vote meant.

I was asked to participate in the counting of the ballots. When the district representative of the management company gave me and the other participant instruction on the counting of the ballots, he told us not to count the IRS measure, as “they would be counted later.”

Once the ballots were counted, the results were brought into the meeting and the members were announced that had won the election. Shortly thereafter, the issue of the IRS Ruling was mentioned. The district representative announced that the measure had passed! I reminded him in front of the group that we had not counted the votes on this issue. He stated he was sure it would pass, so not to worry.

Once the ballots were counted, the results were brought into the meeting and the members were announced that had won the election. Shortly thereafter, the issue of the IRS Ruling was mentioned. The district representative announced that the measure had passed! I reminded him in front of the group that we had not counted the votes on this issue. So now if he certifies that the measure passed, is it not possible fraud? What ramifications does this have for our community if the IRS does an audit? By the board accepting the district representative’s statement, they tacitly violated our voter rights.

If they do get around to counting the votes, how do we know that they are counted fairly? A number of owners did not vote on the issue due to a lack of information, thus making it easy to rig the votes. One wonders if other issues before the board have been handled in this dubious way.

Lastly, our community has 383 lots. Only 31 individuals attended this meeting. That is less than 10 percent of the community. This apathy can allow for possible future abuses of power of the board in their selective enforcement within our community.
