Open meeting law challenge on telecommunications action in Fountain Hills

Action by council Nov. 4 may see further challenge

A proposed ordinance related to telecommunications regulations which have been discussed over more than two years in Fountain Hills appears headed for more delays.

At its Nov. 4 regular session, the Fountain Hills Town Council voted 5-2 to ratify a January 2025 vote to send the proposal back to the Planning and Zoning Commission in an effort to rectify a possible violation of the Arizona Open Meeting Law.

In October, Town Attorney Jennifer Wright received a letter from the Arizona Attorney General’s Open Meeting Law Enforcement Team (OMLET) stating the office had received two complaints related to action taken by the council last January. The office requested a written response from the council within 30 days of the Oct. 15 date on the letter.
